What makes a prenup unenforceable in Indiana?

A prenuptial agreement can help couples decide how property, finances and certain responsibilities will be handled if their marriage ends. When prepared properly, it can provide clarity and minimize a risk of future disputes.

However, not every agreement can be enforced by the courts. Under Indiana prenuptial agreements law, certain problems with how a document was created or what it requires may prevent enforcement.

When can a prenuptial agreement become unenforceable?

A valid premarital agreement in Indiana must be drafted in writing and signed by both parties before the marriage begins. Meeting those formal requirements is important, but it does not automatically make every provision enforceable.

If one person was pressured, threatened or improperly influenced into signing, the court may find that genuine consent was missing. The timing of the agreement and the circumstances surrounding the signature may be relevant if voluntariness is challenged.

Another potential concern is whether a particular agreement was unconscionable when it was executed. This generally refers to terms that were extremely unfair or one sided at the time of signing. The court may review the substance of the agreement and the conditions under which it was created.

Spousal support provisions may also receive separate scrutiny. If an agreement limits or eliminates support and enforcing that term would cause extreme hardship because of circumstances that were not reasonably foreseeable when the agreement was signed, the court may require support despite the written provision.

A prenuptial agreement also cannot require unlawful conduct or include terms that violate public policy. Couples may address property rights, financial responsibilities, estate planning and other personal matters, but those provisions must be drawn up within the limits of Indiana law.

Careful preparation can reduce later disputes about validity. Each person should understand the agreement, have enough time to review it and sign without improper pressure.
